What does the TEMPORARY Partner visa SUBCLASS 820 offer?

This temporary partner visa subclass 820 allows you to live, work and study in Australia while processing the permanent partner visa (subclass 801). You are allowed to travel in and out of Australia indefinitely. 

If eligible, you may also attend the free English language classes provided by the Adult Migrant English Program.

You can also apply for Australia’s public health care scheme.

Eligibility criteria 

  • You must be 18 years or older as married applicants usually are as per Australian law.
  • You must be in a genuine relationship with your spouse or de facto partner.
  • Your partner must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen.
  • You must be in Australia when you apply for this visa and during the decision on your temporary visa application. 
  • Your family included in the application must also be in Australia 

This temporary partner visa cost is from $7,850 for most applicants. For prospective marriage visa holders (Subclass 300), the cost is from $1,310. You are expected to pay for the temporary and permanent visas together.

What does the PERMANENT Partner visa SUBCLASS 801 offer?

The permanent partner visa allows the de facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen to live in Australia permanently. This visa is usually only for people who hold a valid temporary Partner visa (subclass 820).

You can sponsor an eligible family member to come to Australia. You can travel to and from Australia five years from the visa granted.

If eligible, you may also attend the free English language classes provided by the Adult Migrant English Program.

You can also apply for Australia’s public health care scheme.

Eligibility

  • You must hold a temporary Partner visa (subclass 820) while applying for the permanent partner visa.
  • In most cases, you must be in a married or de facto relationship with your sponsor.

This visa may not be granted if it is not in the best interest of an applicant under 18.

The processing time of this visa takes around 12 to 20 months from the date of application.
